Regulation 3290

Gifts, State and Local Grants and Bequests  

 

This Regulation applies to the San Francisco Unified School District and the County Office of Education. 

 

This Regulation describes the process by which staff shall seek approval from the Board of Education for matters related to gifts, grants or bequests.  Whenever possible, the grant agreement shall be attached to the Board item and submitted for Board approval on Boarddocs. If an agreement is not required or contemplated by the awarding organization or agency, staff may use this process to seek acceptance of gifts, grants, bequests or donations and attach relevant documentation.

 

Note:  If a custom grant agreement is contemplated, staff are strongly encouraged to seek legal review from the Legal Office prior to submitting their item on Boarddocs.

 

Privately Funded Gifts and Grants

 

Gifts, grants, donations or bequests (“Grant”) from any individual, private agency or organization shall be submitted to Fund Development for review and submission to the Board.

 

Before submitting the item for board approval, Fund Development shall ensure that: 

(a) the District can fully satisfy any conditions or restrictions imposed by the Grant; 

(b) that any conditions or restrictions imposed by the Grant are consistent with the District’s Vision, Mission, and Core Beliefs; and 

(c) if the Grant involves a gift of books and instructional materials, the Grant meets regular District criteria for selection of instructional materials.

 

In addition, Fund Development shall review the Grant and certify that the Grant does not:

(a) Entail undesirable or excessive costs;

(b) Promote the use of violence, drugs, tobacco, or alcohol or the violation of any law or District policy; and 

(c) Imply endorsement of any business or product or unduly commercialize or politicize the school environment.

 

Fund Development shall submit Grant approvals to the Board by creating an agenda item, selecting the appropriate approval tree, and submitting the item to the Board’s Consent Agenda.

BACKGROUND: The Fund Development Office reviews such gifts and grants to ensure that: 1) the District can fully satisfy any conditions or restrictions imposed by the Grant; 2) any conditions or restrictions by the Grant are consistent with the Districts’ Vision, Mission, and Core Beliefs; and 3) if the Grant involves a gift of books and instructional materials, the Grant meets regular District criteria for selection of instructional materials.

In addition, in seeking Board approval of the attached gifts and grants, the Fund Development Office represents that the Grant does not: 1) entail undesirable or excessive costs; 2) promote the use of violence, drugs, tobacco, or alcohol or the violation of any law or District policy; or 3) imply endorsement of any business or product or unduly commercialize or politicize the school environment

 

Publicly Funded Gifts and Grants

 

Grants from public agencies, including but not limited to the City and County of San Francisco (or any of its departments and agencies) and the State of California, shall be submitted to the Board for approval by the District department responsible for administering the Grant (“Submitting Department”). Please note that is AR does not apply to federal grant funds, which are governed by AR 3230, Federal Grant Funds. 

 

The Submitting Department shall submit Grant approvals to the Board by creating the agenda item, selecting the appropriate approval tree, attaching the grant agreement and submitting the item to the Board’s Consent Agenda. The agenda item shall contain all of the following information:

  1. amount of the Grant;
  2. term of the Grant;
  3. District department and position within the department responsible for administering the Grant and ensuring compliance with any conditions or restrictions contained in the Grant; and 
  4. amount and source of any matching funds required by the Grant.

Before submitting the item for board approval, the Submitting Department shall ensure that:

(a) the District can fully satisfy any conditions or restrictions imposed by the Grant;

(b) that any conditions or restrictions imposed by the Grant are consistent with the District’s Vision, Mission, and Core Beliefs; and

(c) if the Grant involves a gift of books and instructional materials, the Grant meets regular District criteria for selection of instructional materials.

 

In addition, the Submitting Department shall review the Grant and certify that the Grant does not:

(a) entail undesirable or excessive costs;

(b) promote the use of violence, drugs, tobacco, or alcohol or the violation of any law or District policy; or

In submitting this item for Board approval, the Office of State and Federal Programs has verified that:

     1.  the District can fully satisfy any conditions or restrictions imposed by the Grant;

     2.  any conditions or restrictions imposed by the Grant are consistent with the District’s Vision,

          Mission, and Core Beliefs; and

     3.  if the Grant involves a gift of books and instructional materials, the Grant meets regular District 

         criteria for selection of instructional materials.

 

In addition, Office of State and Federal Programs has verified that the Grant does not:

      1. entail undesirable or excessive costs;

      2. promote the use of violence, drugs, tobacco, or alcohol or the violation of any law or District policy; or

      3. imply endorsement of any business or product or unduly commercialize or politicize the school environment.
